Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the Attune mobile application and website (collectively, the “Service”) operated by Attune LLC (“Attune,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Not a medical or therapeutic tool

Attune is a wellness application intended to support general well-being through evidence-informed daily practices. Attune is not a medical device, clinical tool, or therapeutic service. It does not diagnose, treat, cure, or prevent any medical or mental health condition.

Nothing in the Service constitutes professional medical, psychological, or therapeutic advice. If you are experiencing a mental health crisis or have a medical condition, please consult a qualified healthcare professional.

In an emergency, call 911 or your local emergency number, or contact the 988 Suicide and Crisis Lifeline by calling or texting 988.

Subscriptions and billing

Attune offers paid subscriptions on a monthly or annual basis. Subscriptions are processed and managed through the Apple App Store or Google Play Store, depending on your device.

Free trials. We may offer a free trial period before your subscription begins. Your subscription will automatically begin — and your payment method will be charged — at the end of the trial period unless you cancel before the trial ends.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the renewal date. Renewal charges are applied within 24 hours prior to the end of the current period.

Price changes. We reserve the right to change subscription prices. We will give you reasonable advance notice of any price change. Your continued use of the Service after a price change constitutes your agreement to the new price.

Cancellation

You may cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until that date.

We do not offer refunds for partial billing periods except where required by applicable law. For refund requests, contact support@findattune.com.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated tools to access the Service in a manner that exceeds normal usage.
• Share your account credentials or allow others to access the Service using your account.
• Misrepresent your identity or affiliation when contacting us.

Intellectual property

All content, design, code, and materials within the Service are owned by or licensed to Attune LLC and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.

Your mood data and practice history belong to you. We claim no ownership over the personal data you provide.

Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the maximum extent permitted by applicable law, Attune LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

Our total liability to you for any claim arising from these Terms or the Service will not exceed the amount you paid to us in the twelve months preceding the claim.

Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, if we believe you have violated these Terms. You may also delete your account at any time through the app settings.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms at this URL with a new “last updated” date. Continued use of the Service after a change constitutes acceptance of the updated Terms.
